JUSTICE SANJAY PRIYA ORAL ORDER 2/ 23-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Basopatii P.S. Case No.148 of 2015 instituted for the offence under Section(s) 341, 323, 379, 504/34 Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act pending in the Court of the Additional Chief Judicial Magistrate, III, Madhubani.

Prayer of the petitioner for grant of anticipatory bail was earlier disposed off by a co-ordinate Bench of this Court by order dated 08.12.2016 passed in Cr. Misc. No.47890 of 2016 with observation that the petitioner may surrender and make prayer for regular bail.

Accordingly, this Court does not find it a fit case to

Patna High Court Cr.Misc. No.60632 of 2017 (2) dt.23-03-2018 2/2 pass any fresh order in this case.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law, preferably on the same day, without being prejudiced by this order.
