The petitioner apprehends his arrest in Kalyanpur P.S. Case No.03/2017, registered under Section 414/34 of the Indian Penal Code.

The police apprehended one Sudhir Kumar with motorcycle but Sudhir Kumar failed to produce papers with regard to the ownership of the said motorcycle. Sudhir Kumar disclosed that he purchased the said motorcycle from one Chitranjan Rai and Ram Prasad Rai, the petitioner.

Learned counsel for the petitioner submits that Sudhir Kumar happens to be a villager of the petitioner and on account of enmity, this case has been lodged. There is no material to show that the petitioner sold any stolen motorcycle to Sudhir Kumar.

Considering the aforesaid fact, the petitioner above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur, in connection with Kalyanpur P.S. Case No.03/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
