The petitioners apprehend their arrest in Dalsingsarai P.S. Case No.348/2017, registered under Sections 302, 201 and 34 of the Indian Penal Code.
The father of the deceased alleged that when he went to see his daughter on 02.11.2017, he did not find any family members inside the house. Later on, he came to know that Santosh Ram, the husband of his daughter, father-in-law, brothers-in-law, mother-in-law and others killed his daughter Rubi Devi. Learned counsel for the petitioners submits that the petitioners are brothers-in-law, father-in-law and mother-in-law of the deceased. The petitioners are living separately from the family
Patna High Court Cr.Misc. No.39932 of 2018 (2) dt.10-07-2018 2/2 of the deceased and her husband. The deceased died due to diarrhea. Similarly situated other accused persons have already been granted anticipatory bail vide order dated 11.05.2018 passed in Cr. Misc. No.13751 of 2018.
Taking into consideration the aforesaid fact and the nature of allegation made against the petitioners and the fact that the petitioners are brothers-in-law, father-in-law and mother-inlaw of the deceased and similarly situated co-accused namely Rajeev Ram, Raja Ram, wife of Rajeev Ram and wife of Raja Ram have already been granted anticipatory bail, the petitioners above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dalsingsarai, Dist-Samastipur, in connection with Dalsingsarai P.S. Case No.348/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
