2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 26.55 litres of illicit foreign liquor has been recovered from a Scooty.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. No incriminating article has been recovered from the conscious possession of the petitioner.

5. Learned APP for the State has opposed the bail petition and submits that petitioner is the owner of the said

Patna High Court CR. MISC. No.28308 of 2025(2) dt.14-05-2025 2/2 Scooty.

6. Considering the quantity of recovery and the fact that petitioner is registered owner of the Scooty from which the said recovery has been effected, the prayer for anticipatory bail of the petitioner is rejected.
