The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a), 32 and 41 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 2200 litres of liquor is said to have been recovered from the two vehicles and three accused persons were taken into custody.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. The name of the petitioner transpired in the statement of a coaccused and of local Choukidar made before police. The petitioner is in custody since 10.2.2021. Chargesheet has been

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Baikunthpur P.S. Case no.246 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge (Excise), Gopalganj.
