The petitioner has preferred this application for grant of regular bail in a case registered under sections 372, 373, 366, 368, 327 and 120B of the Indian Penal Code and sections 4 and 5 of the Immoral Traffic Prevention Act, 1956. As per the prosecution case, having received confidential information, on the police personnel going to National Highway, it is stated that they saw the accused persons including the petitioner indulging in immoral traffic. It is submitted by learned counsel for the petitioner that the petitioner has not committed any offence. No.39244 of 2021(2) dt.13-01-2022 2/2 petitioner stands on a similar footing to that of six other F.I.R. named accused persons who have been enlarged on bail vide order dated 11.2.2021 (Annexure-2) passed in Cr. Misc. no.39405 of 2020. The petitioner is in custody since 9.9.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case including grant of bail to the other similarly situated co-accused, the petitioner having remained in custody for over 1 year 3 months and not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.105 of 2020 (arising out of Kudra P.S. Case no.286 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge I-cum-Special Judge, Kaimur at Bhabua.
