2. The petitioner apprehends his arrest in connection with Tariyani P.S. Case No. 41 of 2026, registered for the offences punishable under Sections 126(2), 115(2), 109(1), 305, 329(4), 352 and 3(5) of the Bharatiya Nyaya Sanhita.

3. Learned counsel appearing for the petitioner submits that the petitioner and the informant are co-villagers and there is enmity in between them. It is further submitted that earlier Complaint Case No. 58 of 2016 was instituted by the same prosecution party against the petitioner, in which he is already on bail. It is contended that the prosecution story narrated in the FIR is completely fabricated and unbelievable. It is also submitted that the informant has sustained only simple

4. Learned APP for the State has opposed the prayer for bail of the petitioner.

5. In the facts and circumstances of this case and considering the statements made in the petition as well as the above submissions, coupled with nature of allegation appearing against the petitioner, in my opinion, the petitioner deserves to the relief of anticipatory bail. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Tariyani P.S. Case No. 41 of 2026, subject to the conditions as laid down under Section 482(2) of the BNSS. (Shailendra Singh, J) maynaz/- U T
