As a IVth grade employee the petitioner claims to have served the respondent -Zila Parishad, Sitamarhi and retired on 30.10.2012. Since the post retiral dues enlisted in para 9 were not paid to him the writ petition was filed. Mr. Jivan Prakash Sinha, counsel for the petitioner fairly informs the Court that during pendency of the application all the admitted post retiral dues except interest on GPF amount as well as group insurance amount have been calculated and authorized/paid to the petitioner.

Patna High Court CWJC No.7384 of 2015 (2) dt.11-05-2016 2/2 Counsel appearing on behalf of the State submits that funds/financial assistance/grant have been made available to the respondent- Zila Parishad.

Considering the above, in my view, the ends of justice shall be sub served if the writ application is disposed of by the following order:- Let the petitioner file a representation before the Chief Executive Officer of the District Board claiming payment of statutory interest on GPF amount as well as the group insurance amount together with interest, if any, whereafter the said respondent will consider the claim of the petitioner and pass appropriate orders enabling the petitioner to draw the amount under those head(s) in accordance with law. A representation of the petitioner, if filed within 03 weeks shall be considered and disposed of in the light of the observation(s) made above within six weeks of such filing /presentation.
