JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 Petitioners seek bail in anticipation of their arrest in connection with Vaishali P.S. Case No. 60 of 2019, registered for the offences punishable under Sections 379 and 354B/34 of the Indian Penal Code.

Allegation against petitioner No.1 he caught hold of the informant from back, torn her blouse and tried to commit rape upon her and there is allegation against petitioner No.2 that he forcibly snatched a gold chain from her neck and both of them tried to forcibly commit rape upon her.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and there is no allegation of attempting to commit rape against petitioner

Having heard both sides and in view of allegation, I am not inclined to grant the privilege of anticipatory bail to the petitioners, rather they should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
