By order dated 24.03.2023, a report was called for from the Superintendent of Police, Nalanda, in respect of the appellant whether he is alive or dead during the pendency of the present appeal in Sessions Trial No. 324 of 2017, arising out of Telhara P.S. Case No. 02 of 2017.

Mr. Abhimanyu Sharma, learned A.P.P. appearing for the State, submits that he has received a report from the Superintendent of Police, Nalanda and the said report has been submitted by him in the Court. Let it be kept on the record. As per the report of the Superintendent of Police,

Patna High Court CR. APP (DB) No.445 of 2022(7) dt.17-05-2023 2/2 Nalanda, it is stated that the appellant has already died during the pendency of the present appeal.

Considering the same, the present appeal stands abated.
