Though the present petition has been filed for quashing the order taking cognizance dated 11.12.2017, passed by learned court of Sub-Divisional Judicial Magistrate, Nawada in complaint case no. 1308 of 2016, however, the learned counsel for the petitioner submits that the petitioner feels that there is a chance of conciliation and settlement of the matrimonial disputes amongst the parties, hence it is submitted that though the present case may be disposed off but the learned trial court may be directed to at least relegate the parties to the mediation process, so that an attempt can be made to amicably

Patna High Court CR. MISC. No.38485 of 2018(3) dt.25-01-2023 2/2 resolve the matrimonial dispute in question.

The learned counsel for the opposite party no. 2 is also not averse to the idea of the parties being relegated to the mediation process.

In view of the aforesaid, the present petition stands disposed off as not pressed, however, with a direction to the learned court of Sub-Divisional Judicial Magistrate, Nawada to engage the petitioner and the opposite party no. 2 in mediation proceedings with a view to amicably resolve the matrimonial dispute in question.
