JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-09-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 201 of the Indian Penal Code.

The prosecution case as per F.I.R is that the dead body of a woman was recovered. Subsequently, the dead body was identified as the body of Ragini Kumari. The father of the victim Mithlesh Thakur has alleged that his daughter had performed love marriage with the petitioner and subsequently, the in-laws family

Patna High Court CR. MISC. No.30229 of 2023(4) dt.12-09-2023 2/3 including the petitioner have killed the victim for nonfulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the deceased who had performed love marriage with the victim. Hence, the accusation of demand of dowry is baseless and concocted. There is no eye witness to the occurrence. During investigation, it came to light that victim had gone to her Nana's house and due to pressure from her parents, she committed suicide. The independent witnesses who have supported the case of the prosecution are hearsay. During investigation also, no concrete material evidence has been collected against the petitioner. The petitioner is languishing in custody since 31.01.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Barh, Patna in connection with Barh P.S. Case No. 131 of 2021.
