JUSTICE SANJAY PRIYA ORAL JUDGMENT Date: 06-08-2018 This application under Section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 06.07.2000 passed by the Additional Chief Judicial Magistrate, Birpur, in Complaint Case vide Misc. No.02 of 2000 by which the learned Magistrate has taken cognizance against the petitioner for the offence under Section(s) 48 of Bihar Agriculture Produce Market Act, 1960.
The impugned order has been passed on 06.07.2000. It appears that cognizance has been taken on the basis of official complaint filed by the Secretary, Agriculture Produce Market Committee, levelling allegation that he had not deposited the
Patna High Court Cr.Misc. No.54330 of 2016 dt.06-08-2018 2/2 settlement amount of Chatapur Haat for the year 1990-91. The impugned order has been passed in the year 2000. This Court is, therefore, not inclined to interfere with the impugned order.
This application is, accordingly, dismissed.
In the event, petitioner files a petition in the Court below with regard to deposit of the amount, as mentioned in the Complaint Petition, before the competent authority, the Court below will pass appropriate order in accordance with law.
