JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 The petitioner is apprehending his arrest in connection with Garkha P.S. Case No. 119/18, registered for offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he has misused the Government money which was meant for distribution amongst flood victims by recommending the name of more than one person of one family.

It has been submitted on behalf of the petitioner that he is a member of vigilance-cum-screening committee and he himself has also informed about the irregularities committed in distribution of money amongst flood affected persons and he has falsely been implicated in this case and he has no role to play in the defalcation of government money.

Patna High Court Cr.Misc. No.38492 of 2018 (2) dt.29-06-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, this application is disposed of with direction to the petitioner to surrender before the court below within a period of four weeks, on which the court below shall release the petitioner on provisional bail to his own satisfaction till submission of charge-sheet and after submission of charge-sheet, if the allegation against the petitioner is found true, he will have to surrender before the court below and has to pray for regular bail, which will be considered on the merit of the case.
