The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a), 30(b) of the Bihar Prohibition & Excise Act.

Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 1 namely Vinod Manjhi.

Patna High Court CR. MISC. No.32416 of 2022(2) dt.16-09-2022 2/3 Permission is accorded.

Accordingly, the petition with regard to petitioner No. 1 is permitted to be dismissed as withdrawn.

There is recovery of 2 litres of country made liquor from the house of petitioner No. 2.

It is submitted by learned counsel for the petitioner No. 2 that he was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner No. 2.

Considering the meager quantity of illicit liquor, let the petitioner No. 2, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court-1, Gaya in connection with Buniyadganj P.S. Case No. 231 of 2021, subject to the conditions as laid down
