Petitioners apprehend their arrest in connection with Shashtri Nagar P.S.Case No. 197 of 2018 registered for the offences punishable under Sections 147, 447, 341, 323, 427, 379, 504 and 506 of the Indian Penal Code.
Allegation against the petitioners is that they have entered the shop of the informant and damaged the properties and taken away some properties.
Submission of learned counsel for the petitioners is that the house in which the shop is situated belongs to petitioner No.1 and petitioners Nos. 2 and 3 are sons of petitioner No.1 and there is dispute with respect to eviction of the house as the house was
Patna High Court Cr.Misc. No.38915 of 2018 (2) dt.09-07-2018 2/2 damaged by earthquake and petitioners want to repair it but he has not vacated the house, as such, this false and concocted case has been filed.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Patna, in connection with Shashtri Nagar P.S.Case No. 197 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
