This application for anticipatory bail arises out of Sarai P.S. Case No. 143 of 2017, disclosing offences under Sections 147,148,149,341,353,427,337,283,504 of the Indian Penal Code and Section 3⁄4 of the Essential Service Maintenance Act, 1981.

Learned counsel appearing on behalf of the petitioners has submitted that there is general and omnibus allegation against all the persons named in the First Information Report, who were raising slogans against the administration and demanding compensation to the family members of a person who was killed.

Learned counsel for the petitioners has submitted that five of the similarly circumstanced co-accused have been

Patna High Court CR. MISC. No.28372 of 2019(2) dt.30-04-2019 2/2 granted anticipatory bail by this Court by an order dated 23.04.2019 passed in Cr. Misc. No. 26189 of 2019. Considering the above submission, this application is allowed.

Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand)each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateXIII-cum-Sub-Judge-IV,Vaishali at Hajipur in Sarai P.S. Case No. 143 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
