2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 8(c) of the Narcotic Drugs and Psychotropic Substances Act.

3. As per the prosecution case, 45 grams of Ganja, 19 packets of cigarette, 62 pcs. of tablets of Nitzacare-10, 62 pcs. of injections of Pentzonic were recovered from the Gumti of petitioner.

4. It is submitted that the shop in question does not belong to this petitioner and no chit of paper is available on the record which show that the shop in question belongs to this petitioner. Only on suspicion petitioner has been made accused in this case. Petitioner claims clean antecedents.

5. Counsel for informant however vehemently

Patna High Court CR. MISC. No.30309 of 2023(2) dt.17-07-2023 2/2 opposed the prayer for bail and submitted that narcotic substances were recovered from the shop of this petitioner.

6. Considering the facts aforesaid and gravity of offence, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Begusarai Town P.S. Case No. 164 of 2023. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
