====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 14-05-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Amarpur P.S. Case No. 34 of 2018, instituted for the offence under Section (s) 341, 323, 120B, 467, 385, 420, 468, 471, 504 and 506/34 of the Indian Penal Code.

It is alleged in the written report that there is ancestral property of informant which was sold by the ancestors of petitioners and Kailash Mandal. It is further alleged that petitioners executed Kewala in favour of accused persons as named in the written report. Petitioners in order to cheat has executed four sale deeds in favour of other persons as

Patna High Court CR. MISC. No.32084 of 2019(2) dt.14-05-2019 2/2 mentioned in the written report. In such circumstances, it is a matter of pure civil dispute.

Petitioners are in custody since 17.1.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S.
