Mr Suresh Pd Singh No 1, Ms Kumari Rashmi, Advocates ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 04-11-2019 It is submitted by learned counsel appearing for the respondent-Bank that in view of decision of the Division Bench in LPA No 1353 of 2009 and analogous case, the relief, claimed in the writ petition, has become infructuous as the Division Bench has found such relief not to be available to others similarly situated.

The writ petition, as per averments made in paragraph 8, was filed relying upon decision of the Single Bench which now stands merged in the order passed in LPA No 1353 of 2009. When the matter was last taken up on 23.05.2017, none had appeared for the petitioner. Position is same today, again none appears for the petitioner.

Patna High Court CWJC No.2935 of 2012(5) dt.04-11-2019 2/2 In view of the aforesaid circumstance, without going into the merits of the submission advanced by the learned counsel for the Bank, writ petition is dismissed for want of prosecution.
