The petitioner seeks bail in anticipation of his arrest in connection with Shikarpur P.S. Case No.188 of 2018 instituted for the offences under Sections 394 and 307 of the Indian Penal Code.
The petitioner is not named in the F.I.R. and his implication in this case only on the basis of confession of coaccused Dadan Pandey, who has taken the name of petitioner along with other accused persons. The petitioner
Patna High Court CR. MISC. No.30335 of 2020(2) dt.17-12-2020 2/2 claims to be a daily wage earner and states that he has falsely been implicated in this case. The local police has not verified the genuineness of the confessional statement and only on that basis, the petitioner is sought to be prosecuted. Regard being had to the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of ten weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Shikarpur P.S. Case No.188 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
