The petitioner seeks bail in Ballia P.S. Case No. 317 of 2018, instituted for the offence under Section(s) 392 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from possession of the petitioner in the instant case. No Test Identification Parade has been held. The Police during investigation arrested this petitioner along with two other accused persons with two Motorcycles bearing Registration No. BR09J-4963 and BR01BA-5456 for which separate Town P.S. Case No. 729 of 2018 has been lodged. In
Patna High Court CR. MISC. No.31738 of 2019(2) dt.13-05-2019 2/2 that case the seized Motorcycle bearing registration No.BR09J4963 is subject matter of the present case. He further submits that petitioner has already been granted bail in Town P.S. Case No. 729 of 2018.
Petitioner is in custody in the instant case since 21.1.2019. In fact, he has been remanded in the instant case from Town P.S. Case No. 729 of 2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S.
