2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 143, 341, 323, 354, 307, 379, 504, 506 of the Indian Penal Code.

3. As per allegation in the FIR, while the informant and her husband were ploughing the ancestral land by tractor, ten FIR named accused persons came there and forbade them to cultivate the land. On protest made by the informant, they assaulted the informant and his husband as a result of which informant's husband received head injury.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. As per injury report, informant's husband has received one lacerated wound, which is found to be grievous in nature. There is case

Patna High Court CR. MISC. No.31733 of 2023(3) dt.01-08-2023 2/2 and counter case. In the background of the alleged scuffle, there is land dispute. Petitioner has got no criminal antecedent and languishing in judicial custody since 23.02.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Purnea in connection with Jalalgarh PS Case No. 106 of 2022.
