The petitioner apprehends his arrest in connection with Babubarhi P.S. Case No.322 of 2022 registered under Sections 188, 175, 420, 384, 379 of the Indian Penal Code and Sections 40, 42 and 44 of the Clinical Establishment Registration Regulation Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case merely because he is the owner and proprietor of the alleged medical centre where the victims were admitted for operation. It is further submitted that there is no specific allegation against the petitioner. It is only a case of medical negligence.

No.32411 of 2023(2) dt.14-07-2023 2/2 Having considered the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Madhubani in connection with Babubarhi P.S. Case No.322 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
