JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-01-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Karghar (Barhani) PS case no. 152 of 2017 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

The case of the prosecution is that on 1.6.2017 one dead body was found besides the agricultural field and thereafter, the chowkidar of the village had informed the police and the present case was instituted against unknown person.

The learned counsel for the petitioner submits that there is no material to implicate the petitioner in the alleged crime, the petitioner has a clean antecedent and even the case diary shows

Patna High Court Cr.Misc. No.54900 of 2017 (3) dt.10-01-2018 2/2 that apart from suspicion, there is no other material to connect the petitioner with the alleged crime.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender within six weeks before the concerned court, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram in connection with Karghar (Barhari) PS case no. 152 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
