The petitioner seeks bail in connection with Trial No. 3520 of 2019, arising out of Chautarwa P. S. Case No. 280 of 2018, instituted for the offences under Section 392 of the Indian Penal Code.

The petitioner has not been named in the F.I.R.

Patna High Court CR. MISC. No.31380 of 2020(2) dt.02-12-2020 2/3 and his implication in this case is on the basis of confession made by a co-accused / Subhash Yadav in another case. Later, aforesaid Subhash Yadav and the petitioner were remanded in this case.

The learned counsel for the petitioner has submitted that till date there has not been any test identification parade and nothing incriminating also has been recovered from him.

The petitioner is in custody since 04.10.2019. In the three other cases, in which the petitioner has been made accused and about which reference has been made in paragraph 3 of the bail petition, the petitioner has been granted bail.

Considering the entire aspects of the matter, the petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st Bagha, District - West Champaran in connection with

The petition stands allowed.
