Petitioner apprehends his arrest in connection with Case No.22 C - 3 Ex/2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The excise official got information that petitioner had kept huge quantity of liquor under the earth in his under construction house and on such inputs, the excise official raided the house of the petitioner and recovered different brands of Indian made foreign liquor.
Learned counsel for the petitioner submits that nobody is residing in the semi constructed house of the
Patna High Court CR. MISC. No.27534 of 2019(2) dt.29-04-2019 2/2 petitioner. Somebody might have kept the liquor with a view to implicate the petitioner but it appears that the excise official got definite inputs about keeping of liquor in the under construction house of the petitioner and from there, huge quantity of different brands of Indian made foreign liquor was recovered. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
