JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Raghopur P.S. Case No. 83 of 2019 for offences under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.

From perusal of the first information report and also case diary, it appears that the petitioner is order giver and at the instance of the petitioner, firing was done which caused injury to the informant side.

Considering the aforesaid, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. Prayer

Patna High Court CR. MISC. No.31158 of 2020(3) dt.22-03-2021 2/2 for anticipatory bail is rejected.

However, in the event the petitioner surrenders before the court below and seeks regular bail, the court below shall consider and dispose of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
