====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Belsand P.S. Case No. 110 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
As per the prosecution case, marriage of sister of the informant was solemnized with co-accused Rajesh Sharma in the year 2009. After marriage they started demanding dowry and due to non-fulfillment of the same, she was subjected to harassment and torture and on 09.06.2019 at about 11:00 A.M., he got informant that his sister has been killed by setting her on fire sprinkling kerosene oil.
It is submitted that petitioner is father-in-law of the
Patna High Court CR. MISC. No.29037 of 2020(2) dt.02-12-2020 2/2 deceased and husband of the deceased is in custody. There is general and omnibus allegation against this petitioner and during the course of investigation, it has come that, in fact, the deceased caught fire while cooking and she was taken to Primary Health Centre, Belsand and from Belsand she was referred to Sitamarhi Hospital and from there doctor referred her to S.K.M.C.H. and on 07.07.2019 his sister died. It is next submitted that there is no eye-witness to the occurrence and the petitioner is an old man aged about 76 years. Considering the aforementioned facts and circumstances and the husband of the deceased is already in custody, the anticipatory bail application of the petitioner is allowed.
Let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Belsand P.S. Case No.
(2) of the Cr.P.C.
