The petitioner has filed this petition to modify the order dated 21.10.2016 passed in Cr. Misc. No.35854 of 2016. The learned counsel for the petitioner submits that the petitioner was granted anticipatory bail on his undertaking that she would deposit the entire amount i.e. Rs.6,28,602/- within three months from the date of her release on bail but the petitioner did not deposit the amount. The learned counsel for the petitioner submits that no inspection of place of occurrence is made but it appears that anticipatory bail was granted to the petitioner on her undertaking that she would deposit the amount alleged to have been defalcated by her within three months. Considering the facts aforesaid, I do not find the case fit for modification. Accordingly, the modification petition is dismissed.
