====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 120(B), 506 and other allied sections of Indian Penal Code.

As per complaint case, this petitioner came to the house of complainant and threatened to withdraw the case of the land otherwise they would kill him.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that due to old enmity this false and fabricated case has been lodged against the petitioner. It is further submitted that the complainant had already filed a suit under specific performance by T.S. No. 134 of 1996 which is

Patna High Court CR. MISC. No.30818 of 2022(4) dt.09-11-2022 2/2 still pending under the concerned Court.

Learned counsel for the informant vehemently opposed the bail application.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Begusarai in complaint case No. 324 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
