====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner retired from the post of Engineer in Chiefcum- Additional Commissioner-cum-Special Secretary, Rural Works Department, Bihar, Patna w.e.f. 31.03.2015. Petitioner seeks payment of remaining part of gratuity and remaining part of pension along with arrears of pension w.e.f. 01.04.2015 along with 18% statutory interest. He submits that for the said payments, he has time and again represented before the Secretary, Rural Works Department but no payment has been made.

Patna High Court CWJC No.8605 of 2019(2) dt.22-04-2019 2/2 Considering the nature of claim made by the petitioner, petitioner is directed to file a fresh representation before the respondent no. 2, the Secretary, Rural Works Department, Government of Bihar, Patna which will be disposed of within a period of four months from the date of filing of such representation. Any amount due to the petitioner along with admissible interest would be paid within two months thereafter. If certain amounts are inadmissible, the same shall be communicated to the petitioner by a speaking order sent through registered post.

Writ application is disposed of accordingly.
