The petitioners apprehend their arrest in Jehanabad P.S. case No. 586 of 2017 under Section 147, 149, 353, 504 of the Indian Penal Code.
The informant, S.H.O. of town P.S., alleged that both the petitioners along with 40-50 persons came inside the premises of police station and made protest of arrest of Shailesh Kumar.
The learned counsel for the petitioners submits that only peaceful protest was made. There is no allegation that the petitioners assaulted any police official.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.63496 of 2017 (2) dt.12-01-2018 2/2 allegation made against the petitioners and the fact that there is no allegation of assault against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. case No. 586 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
