This is an application for quashing the allegations as contained in First Information Report against the petitioner in Sherghati P.S. Case No. 354 of 2020 dated 28.07.2020 which has been registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that this case is squarely covered by the Judgment of this Court delivered in the Case of Rahul Kumar Vs. State of Bihar in Cr.W.J.C. No. 144 of 2021.

I have gone through the Judgment delivered by this Court. The product in this case is also the same as in Rahul

Patna High Court CR. MISC. No.10707 of 2021(4) dt.13-03-2023 2/2 Kumar Vs. State of Bihar.

For the reasons mentioned in the judgment delivered by this court in the case of Rahul Kumar Vs. State of Bihar in Criminal Writ No. 144 of 2021, this application is allowed. The aforementioned prosecution of the petitioner is quashed.
