This writ application has been filed, seeking quashing of a letter dated 11.04.2019, issued by the Circle Officer, Chhaurahi, whereby temporary settlement made in favour of the petitioner on the basis of him being the highest bidder, has been cancelled.

This is an admitted fact that the petitioner, after having found to be the highest bidder, was required to deposit an amount of Rs. 4,62, 600/- by 10.04.2019, which he did not do. The land, in question, was under attachment under Section 146(1) of the Cr P.C. and for temporary settlement in the

Patna High Court CWJC No.9277 of 2019(6) dt.15-07-2019 2/2 petitioner's favour, the said amount was required to be deposited by him, which he admittedly failed to do. It is also to be noted that the petitioner is said to have deposited a sum of Rs. 55,512/- against the said amount of Rs. 4,62,600/-. In the counter affidavit, which has been filed today on behalf of the State of Bihar, it has been stated that the said amount of Rs. 55,512/- has been refunded and the petitioner has received the said amount on 20.05.2019 itself. This fact has been admitted by the learned counsel for the petitioner. In such circumstance, the impugned communication dated 11.04.2019, issued by the Circle Officer, Chhaurahi, does not require interference by this Court. This writ application is accordingly dismissed.
