JUSTICE VIKASH JAIN ORAL ORDER 12-02-2021 Heard learned counsel for the petitioners and learned APP for the State. Learned counsel for the petitionershas filed an undertaking to remove all defects pointed out by the Stamp Reporter as and when required. It is accordingly directed that all defects pointed out by the Stamp Reporter be removed within one month hereof.

2. The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 504, 506, 324, 354(B), 307/34 of the Indian Penal Code registered in connection with Madhubani Town P.S. Case No. 409 of 2018.

3. It is submitted that the petitioners have been falsely implicated as the informant's side habitually implicates the petitioners in the backdrop of admitted land dispute as evident from Demarcation Case No. 2/2018-19. The injuries in any event are simple in nature and the informant did not appear before the

Patna High Court CR. MISC. No.25308 of 2020(6) dt.12-02-2021 2/2 medical board constituted for the purpose of opinion on the injuries.

4. Learned APP has obtained a copy of the case diary in order to assist this Court, which on request is placed on record.

5. Be that as it may, in the event of the petitioners' arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani Town P.S. Case No. 409 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. if they are not otherwise required in any other case.

6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
