The present application has been filed for transfer of Matrimonial Case No. 1541 of 2022, filed under Section 9 of the Hindu Marriage Act for restitution of conjugal rights from the court of learned Principal Judge, Family Court, Patna to the court of learned Principal Judge, Family Court, Muzaffarpur.

3. Learned Advocate for the opposite party submitted that before the order of this court dated 29.08.2024, wherein notice has been issued to the opposite party, an application for withdrawal of Matrimonial Case No. 1541 of 2022 was already filed before the Principal Judge, Family Court, Patna. However, only on account of the order of this Court, withdrawal of

Patna High Court MJC No.1297 of 2023(3) dt.28-11-2025 2/2 Matrimonial Case No. 1541 of 2022 could not be done.

4. In view of the submission advanced by the learned Advocate for the opposite party, who is intended to withdraw Matrimonial Case No. 1541 of 2022 and for which application is already pending, this Court does not find any reason or occasion to adjudicate the matter any further. Accordingly, the present application stands closed with liberty to the opposite party to pursue his application for withdrawal. (Harish Kumar, J) rohit/- U
