19-09-2018 Heard Sri Radha Mohan Singh, learned counsel for the petitioner and Smt. Renuka Ratnakar, learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of anticipatory bail on behalf of the petitioner in Madhuban P.S. Case No. 244 of 2017 registered for offence under Sections 144, 188, 341, 435, 353, 427, 504 and 120(B) of the Indian Penal Code. Earlier also, the petitioner had approached this Court by filing a petition, vide Cr. Misc. No. 7012 of 2018, for grant of anticipatory bail, however; the said petition stood disposed of with observation that if petitioner appears before the court below within a period of six weeks from the date of order and prays for regular bail, the learned court below was asked to examine the same and pass appropriate order in accordance with
Patna High Court Cr.Misc. No.38919 of 2018(2) dt.19-09-2018 2/2 law, without being prejudiced with the order of this Court, preferably on the same date.
Sri Radha Mohan Singh, learned counsel for the petitioner tried to persuade the Court that it is a fit case for grant of anticipatory bail.
Learned Addl. Public Prosecutor submits that petitioner's prayer for anticipatory bail was already rejected and as such, there is no reason to entertain the same. Fact remains that the anticipatory bail petition of the petitioner was disposed of in the month of February, 2018, still in compliance with the earlier order, he did not appear before the court below and again, he has approached this Court by filing the present anticipatory bail petition. In that view of the matter, while dismissing the present petition, it is desirable to direct the concerned Superintendent of Police to examine as to under what circumstances the petition is still at large. Let a copy of this order be sent to the Superintendent of Police, Motihari forthwith.
