2. The instant petition has been preferred for the following relief:- (i). For the direction upon the respondent Collector to make immediate payment of the amount deposited and dues on up to date calculation against the awards concerning petitioners and his family members passed by the learned Special Land Acquisition Judge, Samastipur on reference in Land Acquisition Case Nos. 17 of 75-76, 95 of 82, 96 of 82, 97 of 82, 98 of 82, 99 of 82, 100 of 82,101 of 82, 102 of 82, 103 of 82

Patna High Court CWJC No.2295 of 2015(5) dt.07-07-2025 2/3 and 104 of 82 with the interest at the rate of 15% per annum from the date of deposit till final payment.

(ii). For grant of penal interest at the rate of 15% on the due and payable amount.

(iii). Any other relief or reliefs as deemed fit and proper in the facts and circumstances of the petitioners' case.

Learned counsel for the petitioners has straightaway taken to the order passed by the Court of the Special Land Acquisition Judge, Samastipur in Land Acquisition case no. 95 of 1952 (Ramesh Prasad Singh Vs. State of Bihar) to submit that at the rate of Rs. 14,000/- per acre, the compensation was to be paid with future interest at the rate of 15% per annum till the payment is made, this order is dated 12.06.1998 (Annexure-1 series). He submits that similar order was passed in total 11 awards and to the best of his knowledge, the entire payment was not cleared.

4. Learned State counsel submits that certain payments were made, however he is unable to inform whether the order passed in the award as recorded above has been complied with or not.

5. In that background, instead of keeping the case

Patna High Court CWJC No.2295 of 2015(5) dt.07-07-2025 3/3 pending, the same is disposed of directing the respondents to look into the matter and if the award has not been complied in toto i.e. the payments have not been made along with the interest, the same has to be cleared in next four months.

6. It is the duty of the learned State counsel to inform the concerned respondents regarding the passing of the present order.
