JUSTICE SANDEEP KUMAR ORAL ORDER 07-05-2025 Heard the learned Senior counsel for the petitioners, Sri N.K. Agrawal, learned APP for the State and the learned counsel for the informant, Sri Raghaw Kumar.
2. The petitioners seek regular bail in a case registered for the offence under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2), 351(3), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioners along with 13 persons are said to have assaulted the victim causing grievous injuries.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.28641 of 2025(2) dt.07-05-2025 2/2 there is case and counter case between the parties and the petitioners have falsely been implicated in this case. The petitioners are in custody since 07.02.2025.
5. Learned counsel for the informant has vehemently opposed the prayer for bail by submitting that the injuries are grievous in nature.
6. Considering the facts and circumstances of the case, this application for regular bail is allowed.
7. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria/concerned Court below in connection with Beladaur P.S. Case No. 36 of 2025.
