2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 8(c) and 21(b) of the N.D.P.S. Act.

3. As per prosecution case, on raid, 7.85 grams of Smack was recovered from apprehended co-accused persons, who disclosed the name of this petitioner as their accomplice.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from possession of this petitioner and he has falsely been implicated in this case merely on the basis of confessional

Patna High Court CR. MISC. No. 28619 of 2026(2) dt.11-05-2026 2/2 statement of apprehended co-accused persons. Save and except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged occurrence.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that 7.85 grams of Smack was recovered from possession of apprehended co-accused persons who disclosed the name of this petitioner as their accomplice. Petitioner as got one criminal antecedent.

6. Considering the facts and circumstances of the case, nature of accusation, recovery of 7.85 grams of contraband substance and criminal antecedent of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
