The petitioner is languishing in custody in connection with Gaya Rail PS case no. 358 of 2018 instituted for the offences punishable under Sections 379 and 420 of Indian Penal Code.

The case of the prosecution, according to the informant, is that some money has been transferred fraudulently from his bank account to the account of one Randhir Singh on two occasions.

The learned counsel for the petitioner submits that the petitioner is not the person, in whose account, it has been alleged that the money has been transferred fraudulently. It

Patna High Court CR. MISC. No.34086 of 2019(3) dt.17-08-2019 2/2 is further submitted that the petitioner is an accused in three other cases, however, only after the petitioner was implicated in the 1st case and granted bail in the said case, he has been made an accused in two other cases.

Having regard to the facts and circumstances of the case and considering the fact that no allegation has been levelled in the F.I.R. qua the petitioner herein, I deem it fit and appropriate to grant regular bail to the petitioner herein on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special A.C.J.M., Rail, Gaya in connection with Gaya Rail PS case no. 358 of 2018.
