JUSTICE MADHURESH PRASAD ORAL ORDER 09-05-2019 Counsel for the petitioner is permitted to correct the description of petitioner No. 49 as it is submitted that there is typographical error in the said description.
Counsel for the petitioner submits that the petitioners were Instructors and are claiming absorption on Class IV posts in terms of decision of this Court in Civil Review No. 344 of 2016 arising out of LPA No. 1489 of 2011. It is submitted by petitioners' Counsel that their claim for absorption comes within the restriction prescribed by the Apex Court in SLP (Civil) No. 32079 of 2015.
The petitioners would be at liberty to raise their individual claim and if the same is found to be covered by the said judgments then the relief similar to that granted to others similarly situated undoubtedly will have to be extended to the petitioners.
It is submitted that the petitioners will raise their claim with individual details before respondent No. 4 claiming benefits of the decision dated 10.8.2016 passed in
10/10 Civil Review No. 344 of 2016 arising out of LPA No. 1489 of 2011 as also the judgment of the Apex Court in SLP (Civil) No. 32079 of 2015.
In the event such claim is made before respondent No. 4, it is needless to say that the same should be considered and disposed of in accordance with law.
The writ petition stands disposed of.
