The petitioner filed this criminal revision petition against the order dated 16.06.2020, passed by the learned Special Judge (Children Court), Gaya in Paraiya P.S. Case No.15 of 2017, by which the learned Special Judge rejected the prayer for bail of the petitioner on the ground that the petitioner has got criminal antecedent and there is every chance of his being associated with the criminals, if the petitioner is released on bail.

Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner helped Tetar Yadav in kidnapping the minor daughter of Dinesh Das, but the allegation is false and concocted. The petitioner is accused in three other cases but all the cases are registered by

Patna High Court CR. REV. No.16 of 2021(3) dt.26-02-2021 2/2 the informant of the present case. In fact on account of enmity, the petitioner is being implicated in the present case. Having considered the submissions that the petitioner is a juvenile and he is in observation home since 22.01.2020, the petitioner, namely, Munna Yadav @ Anuj Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Juvenile), Gaya in connection with Paraiya P.S. Case No.15 of 2017. The order dated 16.06.2020, passed by the learned Special Judge (Children Court), Gaya in Paraiya P.S. Case No.15 of 2017 is set aside.

The criminal revision petition is allowed.
