The petitioner is in custody in connection with Special Case No. 158 of 2019, arising out of Tarabari P.S. Case No. 15 of 2019, for the offence under Sections 353, 323, 325, 307 of the Indian Penal Code and Sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 28.01.2019. He further submits that from the prosecution case it would be evident that 20 litres of country made liquor was seized.

Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for more than three months, the petitioner, named above, is directed to be
