The petitioner apprehends his arrest in a case registered for the offence under Section 379/307 of the Indian Penal Code.

Prosecution case is that while the informant was casting his roof, it is alleged that all the accused persons abused and assaulted the family members of the informant. It is further alleged that the accused persons also entered into the house of the informant and took away ornaments worth Rs. 5 lacs. It is submitted on behalf of petitioner that the allegation of abuse and assault is general and omnibus against this petitioner and no specific overt act has been alleged against him. There is a case and counter case and the case filed from the petitioner's side is in earlier point of time. Injury is simple in nature. Similarly situated co-accused Abdul Matin has already

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III Danapur (Patna) in Sigori P.S.
