2. The petitioners apprehend their arrest in a case registered for the offence under Sections 191(2), 191(3), 190, 329(4), 126(2), 115(2), 118(1), 117(2), 76, 109, 303(2), 324(4), 324(5), 352, 351(2), 351(3) of the Bhartiya Nyaya Sanhita.

3. As per prosecution case, on 05.10.2024, on account of land dispute, all the 11 F.I.R. named accused persons including these petitioners and 4-5 unknown persons, armed with iron rod, Farsa, lathi etc. with intention to commit loot of paddy crops came at the filed of informant and on protest by informant and others, they assaulted informant and her other

Patna High Court CR. MISC. No.29426 of 2025(2) dt.08-05-2025 2/3 family members and also snatched Mangalsutra worth Rs. 20,000/- from the neck of informant and cash of Rs. 8,000/- from the house of informant.

4. Learned counsel for the petitioners submits that on account of dispute, relating to land, the occurrence is alleged to have taken place, in which, both the parties assaulted each other. From perusal of F.I.R., it is apparent that no specific allegation of assault is alleged against petitioner no. 1. So far as petitioner no. 2 is concerned, he is alleged to have assaulted one Nandlal by Farsa and doctor has opined the injury to be simple in nature. Some of the similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 01.05.2025 passed in Cr.Misc. No. 23072 of 2025. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Bettiah, West Champaran in
