The petitioner seeks anticipatory bail in connection with Muffassil P.S. Case No. 59 of 2018, registered for offences punishable under Sections 341, 323, 324, 325, 307, 379, 504 and 506/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is of assault with Gadasa and Khanti upon the head of the nephew and brother of the informant and also snatched golden chain and fled away.

Submission of the learned counsel for the petitioners is that a case and counter case between the parties and they have falsely been implicated in the instant case due to land dispute and save his skin from earlier case, which was filed by the petitioners' side. It is further submitted that the injuries found

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each in connection with Muffassil P.S. Case No. 59 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Nawadah, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
