The present application has been filed for modification of order dated 11.10.2017 passed in Cr. Misc. No. 49714 of 2016 by which provisional anticipatory bail granted to the petitioner on 27.04.2017 was rejected in connection with Kotwali P.S. Case No. 380 of 2016, pending in the court of learned C.J.M. Patna and the petitioner was directed to surrender in the court below within a period of eight weeks from the date of order dated 11.10.2017. Further, the learned court below was also directed to take all necessary steps under the law for appearance of the petitioner in this case.

It is submitted by learned counsel for the petitioner that

Patna High Court Cr.Misc. No.61676 of 2017 (2) dt.03-01-2018 2/2 the petitioner moved before the Hon'ble Apex Court against the order dated 11.10.2017 passed in Cr. Misc. No. 49714 of 2016 vide Special Leave to Appeal (Crl.) No. 9083 of 2017 which was dismissed as withdrawn by order dated 05.12.2017. Hence, the petitioner could not surrender in the court below in time. Learned counsel for the petitioner prays for extension of further time so that the petitioner could surrender in the court below.

Considering the aforesaid facts and circumstances, I find no reason to interfere with this application. Accordingly, the modification application is dismissed. U.K./- (Sudhir Singh, J) U T
