2. The petitioner has preferred this application for grant of regular bail in connection with Paliganj P.S. Case No. 43 of 2026 registered for the offences punishable under Sections 196, 299, 191(2), 191(3), 190 of B.N.S and under Sections 25(1-B)(a), 26, 27, 35 of Arms Act..

As per the prosecution case, based on the written report of informant Rohiteshwar Kumar, Sub-Inspector of Paliganj, Police Station, is that on 22.01.2026, at midnight, about 01:15 AM, during night patrolling, the informant got an information that some miscreants got down from a car and had made firing and also had uttered religious and communal hatred abusive words to create communal riot situation near the Nai
Patna High Court CR. MISC. No.29538 of 2026(3) dt.15-07-2026 2/3 Masjid Chowk, Paliganj. The people in the locality were in terror. The police team reached at the place of occurrence and recovered three fired bullets and a seizure list was prepared accordingly. For the said occurrence, a Sanha No. 947 of 2026, dated 22.01.2026, was registered. Further in the CCTV footage, the informant saw that in the alleged incident, seven persons came by a Tata Punch Car, bearing Registration No. BR01HH8712, and three of them had pistol in their hands, they resorted to firing and started uttering communal hatred abusive words to create terror in the locality. Two persons were identified as Chintu Pandey @ Aadarsh Kumar and Daya Dubey.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that admittedly no one was injured in the alleged firing. It has further been submitted that it has not been clearly established that the the petitioner was one of three persons, who were holding pistols. It has further been submitted that there is no specific allegation against the petitioner, rather, the allegations are general and omnibus in nature. It has further been submitted that there is no recovery of incriminating article from the possession of the petitioner. It has further been submitted that the confessional statement by the

No.29538 of 2026(3) dt.15-07-2026 3/3 petitioner made before the police, while in police custody, has got no evidentiary value and has not led to recovery of any incriminating article. Lastly, it has been submitted that the petitioner has been made accused in seven other cases, but he is on bail in those cases and he is in custody since 01.02.2026, charge sheet having filed against him without there being any allegation of tampering against him.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Heard the parties and perused the record.

Considering the facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Danapur, Patna, in connection with Paliganj P.S. Case No. 43 of 2026 .
